Most rental housing in Nova Scotia is covered by the Residential Tenancies Act and Regulations (the RTA). These laws and regulations lay out the rules of renting in Nova Scotia and their enforcement. In Canada (except Quebec), we also operate under a Common Law system. This means that previously published legal decisions can inform adjudicators and influence how the law is applied.

Every topic in this guide will cover the laws and regulations for rental housing; additionally, in some instances, important legal decisions (or “cases”) that influence how the RTA is applied will also be included under “Previous Legal Decisions”.

Just because there are laws and regulations to protect tenants, doesn’t mean these laws are always being followed. In reality, sometimes tenants are taken advantage of, lied to, and have to be careful when asserting their rights to avoid eviction or retaliation. Some common situations are detailed under “Renters’ Reality”.

There are many ways tenants can fight for their rights under the law. When we know our legal rights and can assert them, we can begin to reclaim power over our housing. To help with this, topics will include a section on “Tips & Tactics” where applicable.
