When you file the Notice of Appeal you will receive a pre-hearing date and a phone number to call in to your hearing. Small Claims pre-hearings typically happen on weekday evenings and can last a few hours. The phone call will include everyone scheduled for a pre-hearing at the same time, and you will likely hear several other cases called before yours. It’s important to call in at the time specified and be on the phone the whole time, you don’t know when your case will be called.

At the pre-hearing the adjudicator will call on you and the respondent to answer some basic questions about your appeal. Be prepared to justify why you are appealing your Residential Tenancies Decision. If the adjudicator finds that there is merit to your appeal, they will schedule a hearing date with you over the phone.

Most hearings are in the evenings, but for matters that you feel will take longer than 3 hours or that you cannot attend in the evening you can request a special hearing time.
