Smoking & Cannabis

A landlord has the right to set reasonable rules in the lease, including banning smoking in units and on the property. For more information on landlord rules, click here.

There are no legal restrictions on cannabis use in private residences. However, landlords can create reasonable rules around recreational cannabis use. These rules can include restrictions on where tenants can smoke and whether or not they can grow cannabis plants.

If a tenant is living in a non-smoking building, these rules also apply to cannabis and vapes.

The rules around cannabis only apply to recreational use, not medical cannabis use. Landlords cannot create restrictions on medical cannabis use because it is protected under human rights legislation. If you need medical cannabis to treat a chronic medical condition (and you can prove this with the appropriate medical records) you can use cannabis in your rental unit.

The only instance where you can be banned from using medical cannabis is if you’re smoking and it’s causing problems for other people in the building.
